is in receipt of #. Dr. Despatch of the 8th of Jany requesting the arrest & transmission to Hongkong of Chen syl keen charged by the Hongkong Authorities with embezzlement.
In reply #. 2. begs to inform #. The Consul that he finds in reference to the 29th Article of the Treaty it is stated that "should natives of China who may repair to Hongkong, to trade incur debts there, the recovery of such debts must be arranged for by the British Court of Justice on the spot &c. &c. But this only refers to cases of debt, for again it is stipulated in the 16th Article that Chinese subjects guilty of any criminal act towards British subjects shall be arrested & punished by the Chinese Authorities." This clearly alludes to acts of Embezzlement, robbery & such like. Now in the present instance the Plaintiff & Defendant being both natives of China & the case being one of embezzlement & not of a trade debt it clearly comes under the provisions of the 16th Article & should be settled by the Chinese Authorities not by the Court at Hongkong. Moreover the name of the Plaintiff is not clearly stated & therefore the case is difficult to act in.
#. E. therefore, begs #. Mr. Consul to request the Hongkong Authorities to desire the Plaintiff to come up to Canton & enter a plaint at the local magistrate's Office, that the case may be dealt with according to the 16th Article of Treaty.
